Introduction

This is the Privacy Statement of Momentum Global Ventures B.V. (hereinafter: “Momentum Global Ventures”, “we”, “our”, or variations thereof).

We are a Dutch legal entity that processes personal data. Processing includes the use of personal data. We process personal data because you use our services or because you have given consent for a specific processing activity.

Momentum Global Ventures values the responsible handling of personal data, which means we handle your data with care. We respect the privacy of all individuals connected to our organization or those who use our services.

Momentum Global Ventures processes your personal data in accordance with current privacy laws. This means, for example, that your personal data is processed for the purposes described in this privacy statement. In all other cases, we will only process your personal data if you have given consent.

This privacy statement explains which data Momentum Global Ventures uses, for what purposes, and how we protect your privacy. If you have questions about your privacy, please contact our Data Protection Officer at privacy@momentum.ventures.

Legal Bases for Processing

We only process your personal data if there is a lawful basis to do so. If we do not have a lawful basis to do so, we do not process your personal data. We process your personal data based on the following legal grounds:

  1. With your explicit consent. If we require your consent, we will request it from you, for example, by completing a consent form.
  2. For the execution of one or more agreements. It is necessary that we know who we are contracting with. Additionally, processing your personal data is necessary to fulfil obligations under various agreements.
  3. To comply with our legal obligations. For example, if the Anti-Money Laundering and Terrorist Financing Act (Wwft) applies to us, we are legally obligated to conduct client investigations, and in some cases, enhanced client investigations.
  4. Because we have a legitimate interest in processing. This includes conducting client investigations for fraud prevention, ensuring careful business management, streamlining internal processes (such as assessing and accepting clients), and preventing money laundering and terrorist financing. Other examples of legitimate interests include processing personal data for commercial purposes such as direct marketing to existing clients (for similar services only), transferring employee data within the organization, and processing data for network security.

Purposes of Processing

In addition to the legal bases, we collect personal data only if we have a justified purpose. These purposes are determined before processing and documented in our processing register. Momentum Global Ventures collects your data for the following purposes:

  1. To conduct our commercial activities.
  2. To (electronically) send you relevant and/or commercial information about current events and developments within Momentum Global Ventures.
  3. To approach you for participation in our meetings and activities.

We process only the data necessary for conducting our business and commercial activities. This means we never process data related to religion, race, or political preferences.

Types of Personal Data

When conducting client investigations, we process the following personal data. The data processed depends on whether you are an individual, sole proprietorship, or a legal entity (such as a B.V. or N.V.).

In any case we will process the below mentioned categories of personal data.

Individual or Sole Proprietorship:

  • Full first name(s)
  • Last name
  • Address (including country)
  • Date of birth
  • Place and country of birth
  • Identification document
  • Type of identification document
  • The number of the identification
  • Issue date of identification document
  • Place and country of issue
  • Transaction data, including IBAN, amounts, name(s) of the account holder, and types of financial instruments
  • Registration number (for sole proprietorships)

Legal Entity, Partnership, or Company (other than sole proprietorship):

  • Full first name(s) of authorized representative(s)
  • Last name of authorized representative(s)
  • Date of birth of authorized representative(s)
  • Full first name(s) of ultimate beneficial owner(s)
  • Last name of ultimate beneficial owner(s)
  • Identification document of ultimate beneficial owner(s)
  • Nature and extent of ownership interests
  • Ownership and control structure

We also determine the purpose and intended nature of the business relationship and process information about the source of funds used for processing.

Identification Document

If an identification document expires, we may ask you to send a new copy of a valid document.

Enhanced Client Investigation

In the case of enhanced investigations, we may ask you to provide a new copy of your identification document with certain details obscured.

Additional Personal Data

We may also process the following personal data:

  • Contact details (phone number, email)
  • Date of birth
  • Gender, marital status, and family composition
  • Nationality
  • Payment details (invoice address, bank account number, credit card details)
  • Work-related data (company name, employer, job title, income)
  • Source of wealth
  • Technical data regarding website usage
  • Data to fulfill our (legal) employer obligations

In certain cases, Momentum Global Ventures processes special personal data, such as health information. This occurs only if justified or if consent is obtained.

The above personal data can be combined in order to send you targeted personalised information.

Sources

We obtain personal data from you or third parties upon request. You have the choice to provide this data, with the option to withdraw consent at any time. However, we may not be able to offer, provide or make certain services available if we do not possess your personal data.

We may also obtain data from public sources, such as the Chamber of Commerce, to engage in business activities. This information could include personal data of contact persons.

Momentum Global Ventures always communicates transparently about how personal data has been obtained.

Data Processing

Your data is processed to enter into agreements, execute our organizational goals, represent our business interests including carrying out activities aimed at increasing customer base (commercial activities), assessing and accepting the relationship with the customer, also in the context of fraud prevention and complying with applicable laws and regulations.

If you fill in a contact form on the website, or send us an e-mail, those personal data will be kept as long as is necessary according to the nature of the form or the content of your e-mail for it to be fully answered and processed.

Retention Period

We do not apply a fixed retention period. We retain your data as long as necessary for the initial purpose of collection. In any case we retain personal data for as long as you use our services, as well as for the period thereafter.

We also retain certain data longer in order to comply with legal requirements.
For example, Tax law (Algemene Wet inzake Rijksbelasting) requires us to retain  payment data for 7 years for the tax authority.

Your Rights

You can request access to your data at any time and you have the right to:

  1. Access your personal data being processed by us.
  2. Information about data processing.
  3. Correct or adjust your data being processed by us.
  4. Delete data being processed by us (the right to be forgotten).
  5. Restrict processing by us.
  6. (if possible) Transfer your data to other parties (data portability).

Furthermore, we would like to point out that you have the right to file a complaint with the Dutch Data Protection Authority. However, we do suggest that prior to the filing of such a complaint you allow us to explore the possibilities to come to a satisfactory solution with you.

It is also possible to withdraw initially given consent to process your personal data.

Third-Party Data Sharing

We may exchange or combine your personal data within Momentum Global Ventures.

In certain cases we use third parties to process personal data. Some of these parties are banks and administrative offices relevant to our services, external service providers,  such as ICT service providers, auditors, or other parties to whom we outsource certain support services. Where possible, we require these parties to act in the capacity of ‘processors’. This implies that we determine the purpose and means of processing and that the processor processes your data according to our instructions and our security requirements. These arrangements are set out in a ‘processor agreement’.

Some processors may be located outside the European Union, where different laws and regulations apply. In such cases, additional agreements are made and measures are taken whereby Momentum Global Ventures will endeavour to ensure that you enjoy the same level of privacy protection as you would have had within the European Union.

Security

We endeavour to take appropriate technical and organisational measures to prevent the loss of personal data or unlawful processing. In terms of IT Security and software, Momentum Global Ventures works with suppliers that have appropriate resources and management procedures to secure the personal data we process in order to prevent unauthorised access or disclosure, maintain data accuracy and ensure proper use.

Objection

If you wish to object to the use of cookies or submit a complaint about the processing of personal data, you can use the complaints procedure as published on the Momentum Global Ventures website.

Upon receipt of a complaint, you will receive a confirmation of receipt. If the complaint is fully described, a substantive response will follow within 14 days. You also have the right to lodge a complaint with the Data Protection Authority.

Cookies

Momentum Global Ventures’ website may use cookies for functional purposes to keep the website working properly. It is important that the website continues to function correctly so that we can provide you with the best possible service. We currently use a Tracking cookie for Google Analytics. We do this to improve the experience on our website. We also use Leadfeeder, which displays data from companies that have visited our website. As of 1 January 2013 it is mandatory to inform you and request your prior consent as to whether Momentum Global Ventures may set certain cookies. However, Momentum Global Ventures may place technically necessary cookies (functional cookies), which are necessary for the operation of the website, without your permission.

Changes

Momentum Global Ventures reserves the right to amend this privacy statement.
